Terms and Conditions: Houseflix (Beta Version)

These Terms and Conditions (“Terms”) govern the access and use of the Houseflix platform, including our website, mobile applications, and software-as-a-service (SaaS) products (collectively, the “Services”). By creating an account or using our Services, you agree to be bound by these Terms.

1. Beta Period and Fees

• Free Access (Beta): Houseflix is currently in a “Beta” testing phase. During this period, the Services are provided to Agents and Leads free of charge.
• Transition to Premium: Houseflix reserves the right to introduce subscription fees or “Premium” features at any time. We will provide you with at least thirty (30) days’ notice via email or platform notification before any fees become mandatory.
• No Obligation to Continue: If you do not wish to transition to a paid subscription after the Beta period ends, you may cancel your account without penalty.

2. Licence and Access

Houseflix grants you a non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes (for Agents) or for property searching (for Leads). You must not:

• Attempt to decompile, reverse engineer, or “scrape” any data from the platform.
• Use the Services for any unlawful purpose or to distribute offensive content.
• Share your account credentials; you are solely responsible for all activity under your login.

3. Agent Responsibilities and Content

As an Agent using Houseflix, you agree that:

• Accuracy: You are solely responsible for the accuracy of Agent Content. You must ensure listings comply with Australian Consumer Law and real estate regulations.
• Intellectual Property Licence: You grant Houseflix a perpetual, royalty-free, worldwide licence to use, host, store, reproduce, and display your Agent Content for the purpose of providing the Services.
• Privacy Compliance: You warrant that you have obtained all necessary consents to upload Lead data or client databases to the Houseflix platform in accordance with the Privacy Act 1988 (Cth).

4. Limitation of Liability (The “Beta” Shield)

To the maximum extent permitted by law:

• “As Is” Basis: During the Beta phase, the Services are provided “as is” for testing purposes. We do not warrant that the Services will be uninterrupted, error-free, or 100% secure.
• No Liability for Data Loss: Houseflix shall not be liable for the loss of any data, listings, or lead information during the Beta period. You are encouraged to maintain your own backups.
• Indirect Loss: Houseflix shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or loss of property sales, arising out of your use of the platform.
• Liability Cap: During the free Beta period, our total liability for any claim arising under these Terms is limited to $100 AUD.

5. Indemnity

You agree to indemnify and hold Houseflix harmless from and against any claims, damages, costs, or expenses (including legal fees) arising from:

• Your breach of these Terms.
• Your Agent Content (e.g., copyright infringement or misleading listing info).
• Any disputes between you and a Lead or third party.

6. Overseas Service Providers

As outlined in our Privacy Policy, Houseflix utilises overseas service providers (primarily in the USA, India, and the Philippines) to manage and maintain the software. You acknowledge that your data may be accessed or stored in these jurisdictions to facilitate the 24/7 operation of the platform.

7. Termination

• By You: You may cancel your account at any time via your account settings.
• By Us: Houseflix may suspend or terminate your access immediately if you breach these Terms or if we decide to discontinue the Beta phase.

8. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of that State.
